1. Seller, Scope and Sales Channels

These Terms & Conditions of Sale (“Terms”) apply to purchases made by consumers of vintage clothing, footwear, handbags and accessories sold by Aline Deumaga, an individual entrepreneur (entrepreneur individuel — EI) trading under the commercial name Vintage Christal.

Seller identification

  • Trading name: Vintage Christal
  • Business owner: Aline Deumaga
  • Legal status: Individual entrepreneur (EI), operating under the micro-entrepreneur regime
  • SIREN: 106 002 371
  • Business address: Sous Les Roches, 71390 Montagny-lès-Buxy, France
  • Email: vintagechristal@gmail.com
  • Website: https://vintagechristal.com
  • VAT: VAT not applicable pursuant to Article 293 B of the French General Tax Code (Code général des impôts), subject to continued eligibility for this exemption.

Sales are made through the Vintage Christal website and the official Vintage Christal shop hosted on Etsy.

For purchases made on Etsy, the platform’s own ordering, payment, buyer-protection and dispute-resolution procedures also apply. These Terms supplement the platform’s rules only insofar as they are compatible with those rules and with mandatory legal provisions.

Vintage Christal does not operate a physical showroom and does not offer in-person collection of orders.

2. Unique Vintage Items and Product Descriptions

Vintage Christal selects pre-owned pieces for their craftsmanship, character and history. Each piece has lived a life before joining a new wardrobe and may show normal signs of age or previous use.

Material characteristics, measurements, condition assessments and any significant known imperfections are described as accurately as possible and, where practicable, illustrated with photographs.

Vintage labels may differ from modern sizing. Customers are encouraged to consult the flat measurements provided, in centimetres and inches where available, and to contact us before ordering if they require further information.

Disclosed age-related characteristics do not remove the seller’s mandatory legal obligations or the consumer’s statutory rights.

Colours may vary slightly depending on screen settings, lighting and display technology.

3. Availability and Orders

Most items are unique pieces offered in a quantity of one. Adding an item to the shopping cart does not constitute a reservation.

Before confirming an order, the customer can review the selected item, total price, delivery options and applicable terms. Confirming the order entails an obligation to pay.

An order confirmation is sent electronically.

If an item becomes exceptionally unavailable due to a simultaneous sale or a stock error, the customer will be informed as soon as possible. Any payment received for the unavailable item, together with applicable delivery charges, will be refunded in accordance with the applicable legislation.

Vintage Christal manages stock across several sales channels but cannot guarantee that technical synchronisation errors are entirely impossible.

4. Prices and Taxes

Prices are displayed in euros.

For as long as the seller benefits from the French VAT exemption, VAT is not applicable pursuant to Article 293 B of the French General Tax Code (Code général des impôts). Prices should therefore not be interpreted as including VAT charged by Vintage Christal.

The total amount payable, including delivery charges and any applicable charges collected by the seller or the platform, is displayed before payment.

Prices offered on third-party marketplaces may differ from those displayed on the website.

For international orders, local taxes, import duties or customs charges may be collected by a marketplace, carrier or public authority in accordance with the applicable rules. Charges not collected at checkout may remain payable by the recipient where legally required.

5. Payment

The website accepts card payments processed through Stripe and Apple Pay where these methods are offered at checkout, together with any other payment method actually displayed at the time of payment.

Vintage Christal does not store customers’ full payment-card numbers.

For purchases made on Etsy, payment is processed through the systems and payment methods offered by Etsy.

Payment is due when the order is placed.

The goods remain the property of the seller until full payment has been received, without prejudice to the applicable statutory rules governing the transfer of risk.

6. Order Preparation, Delivery and Transfer of Risk

Orders are normally prepared for dispatch within 2–3 working days following payment confirmation, excluding weekends and French public holidays, unless otherwise stated before purchase.

Available delivery services, destinations, charges and estimated delivery times are displayed during checkout. Depending on the destination, options may include home delivery, delivery to a collection point or locker in selected European destinations, and express delivery where offered.

Delivery charges are calculated according to the total order weight, destination and selected service.

A tracking reference is provided where the selected service allows it.

The risk of loss of or damage to the goods transfers to the customer upon physical possession of the goods, in accordance with Article L. 216-2 of the French Consumer Code, except in circumstances provided for by law.

If a delivery delay is reported, Vintage Christal will contact the carrier to obtain information about the parcel’s progress and take the appropriate steps.

Further practical information is provided in the separate Delivery Policy, which should be interpreted consistently with these Terms.

SECURE SHIPPING

For certain high-value items, Vintage Christal may opt for delivery requiring a signature or secure collection, depending on the services available and the arrangements communicated at checkout.

If a parcel arrives visibly damaged, opened or incomplete, we invite the customer to take photographs, report the irregularities to the carrier and contact Vintage Christal as soon as possible at vintagechristal@gmail.com.

The absence of a formal reservation or complaint made to the carrier does not deprive the consumer of their statutory rights.

7. Delivery Address, Customs and Import Formalities

Customers are encouraged to check their delivery details carefully before completing their order.

If an incorrect or incomplete address supplied by the customer results in a parcel being returned, Vintage Christal may request reimbursement of the reasonable additional costs necessary for a new dispatch, subject to applicable consumer law and the circumstances.

International shipments are declared accurately. Commercial goods cannot be declared as gifts or assigned an artificially reduced value.

For destinations outside the European Union, import duties, import VAT or customs-clearance fees may apply unless they have already been collected at checkout or the applicable regulations provide otherwise.

Where a parcel is returned to Vintage Christal because it was not collected within the period specified by the carrier or because the customer supplied an incorrect address, Vintage Christal will contact the customer to seek a solution. Any additional costs actually incurred and duly substantiated for a new dispatch may be charged to the customer to the extent permitted by applicable law. If no solution can be agreed upon, the order will be handled in accordance with the applicable legal provisions.

8. Statutory Right of Withdrawal — 14 Days

Consumers generally have a statutory right of withdrawal of 14 calendar days for distance purchases, subject to the exceptions provided by law.

For goods, this period begins on the day after the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods. Where several goods in the same order are delivered separately, the period begins on the day after receipt of the final item.

The consumer is not required to give a reason for exercising this right.

The consumer may notify Vintage Christal of their decision to withdraw by sending an unambiguous statement to vintagechristal@gmail.com or by using the model withdrawal form provided below. Withdrawal may also be exercised through the online withdrawal functionality that must be made available on the website in accordance with applicable legislation. For purchases made through a marketplace, the withdrawal procedures offered by the relevant platform may also be used.

Simply returning an item without an unambiguous notification of the decision to withdraw may not be sufficient.

The statutory right of withdrawal generally also applies to second-hand and discounted items. Only exceptions provided by law may exclude this right. Any applicable exception must be brought to the consumer’s attention before purchase.

9. Returns Following Withdrawal and Condition of Items

After notifying Vintage Christal of their decision to withdraw, the consumer must return the goods without undue delay and no later than 14 days after that notification.

Returns must be sent to:

Vintage Christal
Sous Les Roches
71390 Montagny-lès-Buxy
France

Direct return-postage costs are borne by the consumer where this information was communicated before purchase, unless otherwise required by law.

Tracked and insured shipping is recommended but is not compulsory. Original packaging is appreciated where available, but its absence does not automatically invalidate the statutory right of withdrawal.

Customers may reasonably examine and try on items to establish their nature, characteristics and fit.

Where a removable security seal is attached, we ask the customer to keep it intact during fitting and not to remove it before deciding to keep the item. Wherever possible, the seal is attached without piercing or damaging delicate vintage fabrics.

However, handling beyond what is necessary to establish the nature, characteristics and fit of an item may make the consumer liable for any actual and justified diminished value, under the conditions provided by law.

Vintage Christal may photograph items and record security-seal numbers before dispatch in order to document their condition. A seal does not certify that an item is free from defects and does not limit statutory guarantees.

Statutory rights relating to defective goods or goods that do not conform to their description remain fully applicable.

PREVENTION OF ABUSIVE USE

Vintage Christal reserves the right to review, on a case-by-case basis, situations presenting objective indications of fraud or abusive use, while respecting consumer rights and the applicable personal data protection regulations.

Any measures taken will be proportionate, justified and will not affect statutory withdrawal rights or legal guarantees.

10. Refunds Following Withdrawal

Where the consumer validly exercises the right of withdrawal for the entire order, Vintage Christal refunds the amounts received for the goods together with the initial delivery charges corresponding to the least expensive standard delivery method offered. Any additional amount paid for a more expensive delivery method is excluded from this refund.

Where the withdrawal concerns only part of an order, the treatment of the initial delivery charges will be determined in accordance with applicable legislation and the circumstances of the order.

Refunds are made without undue delay and no later than 14 days after notification of withdrawal. Vintage Christal may defer the refund until the goods have been received back or until proof of their dispatch has been provided, whichever occurs first.

The refund is made using the original payment method, unless the consumer expressly agrees to another method. No additional refund fees will be charged.

For purchases made through a marketplace, refunds follow the platform’s applicable processing procedures.

11. Statutory Guarantees

Second-hand goods sold by a professional remain covered by the applicable French statutory guarantees, including the legal guarantee of conformity and the legal warranty against hidden defects, subject to the specific conditions applicable to each.

These guarantees are separate from the right of withdrawal and cannot be excluded solely because an item is vintage or because certain age-related characteristics have been disclosed.

Customers who believe that an item is defective or does not conform to its description are invited to contact vintagechristal@gmail.com, providing their order details and, where relevant, supporting photographs.

Available remedies, applicable time limits and rules concerning the burden of proof are those provided by law.

No additional commercial warranty is offered unless expressly stated otherwise.

12. Customer Service, Complaints and Consumer Mediation

Customers are invited to contact Vintage Christal first in order to seek an amicable resolution to any complaint.

Contact: vintagechristal@gmail.com

If a prior written complaint has not resulted in a satisfactory resolution, an eligible consumer may refer the dispute free of charge to the consumer mediator appointed by Vintage Christal, subject to the statutory admissibility requirements.

The consumer retains the right to bring proceedings before the competent courts.

13. Applicable Law, Amendments and Evidence

These Terms are governed by French law, without depriving consumers residing in another country of any mandatory consumer-protection provisions applicable to them.

The version of the Terms in force at the time the order is placed applies to that order.

Order confirmations and transaction records may be retained as evidence in accordance with applicable legislation.

In the event of a discrepancy between the French and English versions, the French version shall prevail, subject to mandatory consumer-protection provisions and any language requirements applicable to the transaction.

14. Relationship with Other Policies

The following documents are available separately for ease of consultation:

  • Delivery Policy
  • Returns & Refunds Policy
  • Privacy & Cookies Policy
  • Vintage Condition Guide

Mandatory legal provisions prevail over any conflicting contractual wording.

For orders placed through Etsy, the buyer-facing policies and procedures of Etsy must be configured consistently with applicable legislation and the terms governing transactions on that platform. These website Terms do not replace Etsy’s own payment, complaint-management or dispute-resolution procedures.
